The Biden administration is once again making an attempt to forgive the student debt of millions of Americans following the Supreme Court’s rejection of their initial effort. The U.S. Department of Education is set to contact borrowers who may qualify for widespread loan forgiveness in the upcoming days, with the aim of providing relief in the fall, just weeks before the 2024 presidential election. U.S. Secretary of Education Miguel Cardona expressed the administration’s commitment to rectifying the failures of the current system by offering student debt relief.
Opting Out of Forgiveness
Borrowers who wish to opt out of the debt forgiveness opportunity must notify their loan servicer by August 30, as announced by the Education Department. Individuals who are eligible for either partial or full debt cancellation are those who have accrued more debt since beginning repayment and those who have been making loan payments for several decades.
Plan B for Student Loan Forgiveness
In response to the Supreme Court’s rejection of President Joe Biden’s initial attempt at broad student loan forgiveness, the White House has formulated an alternative strategy. Initially, President Biden sought to cancel student debt through an executive action, which was blocked by the Supreme Court. As an alternative, the Education Department has been instructed to pursue the regulatory process, a move that experts believe will increase its chances of withstanding future legal challenges.
